Yorkshire Stoves Terms & Conditions

By placing an order online at Yorkshire Stoves you will be deemed to have read, understood and agreed to our terms and conditions.

Completion of the contract between you and Yorkshire Stoves takes place upon dispatch of the items ordered, unless you have notified us that you wish to cancel your order or we have notified you that we are unable to accept your order.

No conditions or stipulations in or attached to the buyers order which are inconsistent with the seller’s terms and conditions of sale or which purport to add to them or modify them in any way, shall be deemed to have withdrawn or waived the said conditions or stipulations and to contract solely on the seller’s terms and conditions of sale.

Pricing And Descriptions

Yorkshire Stoves reserves the right to change the prices or technical specifications of the products and within the website at any time without notice.

All the product and price details listed in the Yorkshire Stoves website are correct at the time of publication.

We accept no liability for errors or omissions contained therein or resulting from the misuse of any of the information provided.

Although we strive to display the correct texts, images and pricing on the site and web shop, errors may occur.

If you have been charged the wrong amount in the web shop, we will give you the option of placing a new order with the correct price or cancelling your order.

Yorkshire Stoves, however, reserves the right to cancel any order prior to dispatch should we find that the price is incorrect.

In such case we will notify you by email. If we are unable to contact you, your order will be automatically cancelled.

Payment

Individual item prices are quoted in (£) Pounds Sterling.

Payment must be received in full before orders can be released. Goods remain the property of Yorkshire Stoves Direct until payment is received in full.

In the event of having to re-present a credit card payment that is in arrears, Yorkshire Stoves understands and will exercise our statutory right to claim interest and compensation for debt recovery costs under the late payment legislation if we are not paid according to our agreed terms.

Availability

All items are subject to availability calling to see if the item is in stock would be recommended.

We will inform you as soon as possible if the goods you have ordered are not available.

Delivery

We deliver all Stove orders to mainland UK – please contact fro a price.

Dispatch for delivery on goods in stock will take 7-10 working days from the confirmation of your order (by email from us) Sometimes it can take up to six weeks.

We will inform you by phone of the estimated lead time for your delivery.

Deliveries are made by a large tail lift lorry. The delivery vehicle must be able to park in the area which delivery is needed. Examples of areas we would be unable to deliver to are gravelled driveways or narrow lanes.

It is the customer’s responsibility to inform us in advance of any difficulty with access for a 7.5 tonne lorry with tail lift.

We will endevour to look into alternative arrangements if this should be the case, but if a delivery agency cannot gain access or has to be cancelled we will be charged by our carrier for the delayed or failed delivery and these additional costs shall ultimately fall to the customer.

Yorkshire Stoves are only responsible for delivery to your front door. Storage and moving of any delivery is the customer’s responsibility.

Please ensure there will be someone available to help the driver unload.

Customers are required to inspect their delivered goods thoroughly before signing depatch note. Any problem must be noted on the despatch note and Yorkshire Stoves informed as soon as is practical.

If the defect is covered by our guarantee the goods will be repaired or replaced.

Please note that each order can only be delivered to a single address.

We recommend that you do not book a date for fitting until the item has been delivered.

Whilst we strive to make every order run smoothly, occasionally delays can occur. We are not liable for any costs incurred by you, or for any loss of earnings resulting from these delays.

Notices

Unless otherwise expressly stated in these terms and conditions, all notices from you to us must be in writing and sent by e-mail to our contact address at [email protected] and all notices from us to you will be displayed on our website from time to time.

Cancellations

In the case of web purchases of stock items you have the legal right to cancel your order within 7 days of receiving your goods and all items should be returned in a saleable condition (not installed, used or damaged in any way).

If collection of an item is required, where goods are not faulty we will charge you the cost of collection which will be discussed prior to arrangements being made.

Cancellations must be in writing by post or by email to email address here quoting the Order Number.

You have the right to receive a refund within 30 days of cancellation. Please retain the packaging from your order incase it needs to be returned.

If an order is cancelled after the shipping process has begun we will unfortunately have to hold you liable for any charges incurred from our carrier.

Returns & Replacements

Our aim is to supply every delivery in perfect condition. However stoves are both heavy and fragile, so must be carefully handled until installation.

Please note that we cannot accept return of products which are damaged after delivery so it important that you have checked the goods in full before signing for them.

If any goods need to be returned we will advise you of which carrier to use for the return. The cost of returning the item to us is your responsibility.

Returned items to us must be sent by recorded delivery.

Events Beyond Our Control

We shall have no liability to you for any failure to deliver goods you have ordered or any delay in doing so or for any damage or defect to goods delivered that is caused by any event or circumstance beyond our control including, without limitation, strikes, lockouts and other industrial disputes, breakdown of systems or network access, flood, fire, explosion or accident.

Privacy

You acknowledge and agree to be bound by the terms of our privacy policy.

Third Party Rights

Except for our affiliates, directors, employees or representatives, a person who is not a party to this agreement has no right under the UK Contracts (Rights of Third Parties) Act 2000 to enforce any term of this agreement but this does not affect any right or remedy of a third party that exists or is available apart from that Act.

Governing Law

Each and every transaction carried out is deemed to be completed within the United Kingdom and therefore shall be governed by and interpreted in accordance with English Law.

The terms of this charter (and any dispute, controversy, proceedings or claims of whatever nature in relation to them) shall be governed and interpreted in accordance with English Law and the English Courts shall have exclusive jurisdiction in relation thereto.

Entire Agreement

These terms and conditions, together with our current website prices, delivery details, contact details and privacy policy, set out the whole of our agreement relating to the supply of the goods to you by us.

Nothing said by any sales person on our behalf should be understood as a variation of these terms and conditions or as an authorised representation about the nature or quality of any goods offered for sale by us.

Save for fraud or fraudulent misrepresentation, we shall have no liability for any such representation being untrue or misleading.

We make no representations or warranties about the accuracy completeness or suitability for any purpose of the information and related graphics published on our website.

From time to time our site may contain technical inaccuracies or typographical errors.

All liability Yorkshire Stoves how so ever arising for any such inaccuracies or errors is expressly excluded to the fullest extent permitted by law.

Notwithstanding the foregoing, nothing in these terms and conditions is intended to limit any rights you may have as a consumer under applicable local law or other statutory rights that may not be excluded nor in any way to exclude or limit our liability to you for any death or personal injury resulting from our negligence.

All trademarks, product names and company names or logos sited here in are the property of their respective owners.

No permission is given from Yorkshire Stoves Direct in respect of the use of any such brand names, product names or titles or copyrights and such use may constitute an infringement of the owners’ rights.
